Who we are & acceptance

Bloomzy is a service operated by MindEssence Nutrition LLC d/b/a Bloomzy ("we", "our", "us", the "Company"), a Florida limited liability company. The service is available at bloomzy.ai.

By creating an account and using Bloomzy, you agree to these Terms of Service. If you do not agree, please do not use the service.

Bloomzy is offered to users in the United States and Latin America.

The service

Bloomzy provides AI-assisted social media content creation and scheduling tools. We offer the following plans:

• Trial: 30 days free, no card. 120 units, 1 brand, every feature unlocked. No charge during the trial period.
• Core: $29/month, 1 brand, 120 units per month.
• Scale: $49/month, 3 brands, 360 units per month.

Annual plans are available at a discount. Units reset at the start of each billing period.

Units are consumed as follows:

• Uploading a file is free.
• For each piece of content, the first AI operation of a given kind is included. Repeating that same operation on the same piece costs 1 unit.
• Publishing consumes units by content type: 1 for a feed post, 1 for a carousel, 1 for a story, 2 for a tweet, and 3 for a reel.

Your account

• You must be at least 18 years old to use Bloomzy.
• You are responsible for keeping your login credentials secure.
• You are responsible for all activity that occurs under your account.
• You may not share your account with others. Each account is for a single operator.

Your content

You retain full ownership of all photos, videos, text, and brand assets you upload. By using Bloomzy, you grant us a limited, non-exclusive license to process your content solely to provide the service — generating captions, editing images, processing video, and posting to your connected social accounts on your behalf.

We do not claim ownership of your content. We do not use your content to train AI models.

Social media authorization

When you connect a social media account (Instagram, Facebook, YouTube, X, TikTok), you authorize Bloomzy to act as your agent for the specific actions you approve. Bloomzy requests only the permissions necessary to publish content on your behalf. You may revoke this authorization at any time from Settings or from the respective platform's app management page.

You acknowledge that your use of each connected platform remains subject to that platform's terms of service, and that platform API changes or access revocations may affect Bloomzy's functionality. Bloomzy is not affiliated with or endorsed by Meta, X, Google, or TikTok.

By using Bloomzy's YouTube integration, you agree to be bound by the YouTube Terms of Service. Your use of YouTube features within Bloomzy is also subject to the Google Privacy Policy.

By using Bloomzy's TikTok integration, you agree to be bound by the TikTok Developer Terms of Service and the TikTok Music Usage Confirmation. If your post is marked as branded content, you additionally agree to the TikTok Branded Content Policy. Your use of TikTok features within Bloomzy is also subject to the TikTok Privacy Policy. Bloomzy requests the user.info.basic scope solely to display your connected TikTok username, and the video.publish scope solely to post content you have approved to your TikTok profile via the TikTok Content Posting API Direct Post endpoint. Bloomzy does not access, modify, or delete any existing TikTok content, comments, analytics, or profile data beyond your public username and avatar.

AI-generated content

Bloomzy uses AI (Anthropic Claude, Stability AI, OpenAI Whisper, and other third-party providers) to generate captions, edit images, transcribe audio, and suggest content based on the materials, brand information, and approvals you provide. No content is published without your explicit approval.

You are the author and bear ultimate responsibility for the content you approve and publish, including its truthfulness and compliance with advertising laws in your jurisdiction.

Bloomzy does not generate synthetic persons (AI-created humans). If you incorporate into your content material featuring synthetic performers from other tools (avatars, AI-generated presenters), it is your responsibility to comply with applicable disclosure requirements — including laws such as NY GBL §396-b for advertising — and to use each platform's AI content labeling tools as required.

Bloomzy does not warrant that AI-generated content is free of errors. Reviewing content before publication is part of the service and your responsibility.

Acceptable use

You agree not to use Bloomzy to:

• Post content that is illegal, harmful, abusive, or infringes on third-party rights.
• Engage in spam, phishing, or malware distribution.
• Attempt to reverse-engineer, scrape, or bypass the service.
• Use the service in a way that violates the terms of any connected social platform.
• Post content designed to mislead, defraud, or harass.
• Impersonate any person or entity, including Bloomzy staff.

Billing and cancellation

• The 30-day free trial does not require a payment method. You will not be charged during the trial, and nothing is charged when it ends. We send an email reminder before the trial ends. On day 31 you choose a plan to keep creating; everything you already made stays in your account. Once you are on a paid plan, you can cancel anytime from Settings → Billing.
• After the trial, your subscription begins automatically at the plan price and auto-renews monthly or annually depending on your selected billing cycle.
• Monthly plans auto-renew every month. Annual plans auto-renew every 12 months.
• You can cancel at any time from Settings → Billing in your account.
• Cancellations take effect at the end of the current billing period. No partial refunds are given for unused time.
• Refund windows: 7 days from first monthly charge, 14 days from first annual charge. See Refund Policy for details.
• Failed payments enter a 3-day grace period before account suspension. You will be notified by email.
• Price changes require 30 days advance notice by email.

Third-party services

Bloomzy relies on third-party services (listed in our Privacy Policy) to deliver features. Service interruptions, API changes, or pricing changes in those services may affect Bloomzy's functionality. We are not liable for losses resulting from third-party service changes beyond our control.

Service availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. We are not liable for losses resulting from downtime, errors, or changes to third-party social media APIs.

Termination

We reserve the right to suspend or terminate accounts that violate these terms, fail to pay, or engage in abusive behavior toward staff or other users. You may delete your account at any time via Settings → Danger Zone or by emailing us. See our Data Deletion page for what happens to your data.

Disclaimers and limitation of liability

Bloomzy is provided "as is" and "as available". We make no warranties, express or implied, regarding the service, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Bloomzy's total liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.

Indemnification

You agree to indemnify and hold harmless Bloomzy, its officers, employees, and contractors from any claim, damage, or expense (including reasonable attorneys' fees) arising from: (a) your content published through the service; (b) your violation of these terms; (c) your violation of any third-party rights or laws; (d) your violation of any connected platform's terms.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute arising from these terms or your use of the service will be resolved in the state or federal courts located in Florida.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated to active users by email at least 30 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the new terms.
